KOMERSIALISASI RESTORATIVE JUSTICE MELALUI TINJAUAN MORFOGENESIS SOSIAL DALAM PRAKTIK PENYELESAIAN PERKARA DI INDONESIA

Abstrak


Artikel ini mengkaji fenomena komersialisasi restorative justice di Indonesia dengan menggunakan kerangka teori morfogenesis sosial Margaret Archer. Restorative justice yang semula lahir sebagai pendekatan penyelesaian perkara berbasis pemulihan dan keadilan komunal kini mengalami pergeseran makna akibat penetrasi logika pasar ke dalam sistem hukum. Permasalahan utama yang dikaji adalah bagaimana struktur, budaya, dan agen berinteraksi dalam proses komersialisasi praktik restorative justice serta implikasinya terhadap akses keadilan masyarakat. Metode yang digunakan adalah kajian pustaka sistematis terhadap literatur sosiologi hukum dan kebijakan hukum pidana dalam kurun waktu sepuluh tahun terakhir. Temuan menunjukkan bahwa komersialisasi restorative justice merupakan hasil dari interaksi kompleks antara morfogenesis struktural berupa perubahan regulasi, morfogenesis kultural berupa pergeseran nilai keadilan, serta peran agen sebagai mediator dan advokat yang beroperasi dalam logika profit. Proses ini menghasilkan bentuk baru restorative justice yang semakin eksklusif dan tidak terjangkau oleh kelompok rentan. Artikel ini menyimpulkan bahwa tanpa regulasi yang ketat dan komitmen negara terhadap nilai keadilan restoratif yang autentik, komersialisasi akan terus memperlemah potensi transformatif dari pendekatan ini.
